Terms and Conditions of Sale

Please read these Terms and Conditions carefully before completing any purchase at CARS GOLD. By making payment and taking delivery of a vehicle, you confirm that you have read, understood, and agreed to be bound by these terms in full. These terms constitute the entire agreement between CARS GOLD and the purchaser and supersede any prior verbal or written representations.
These Terms and Conditions apply to all vehicle sales conducted by CARS GOLD and are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008, where applicable.
1. Definitions
"CARS GOLD" refers to the dealership operating under the name CARS GOLD, based in Johannesburg, Gauteng, South Africa.
"Customer" or "Purchaser" refers to any individual or entity that purchases a vehicle from CARS GOLD.
"Vehicle" refers to any motor vehicle listed for sale by CARS GOLD, whether new or pre-owned.
"Date of Purchase" refers to the date on which full payment has been received and a sale agreement has been signed by both parties.
"Guarantee" refers to the limited 2-month mechanical guarantee described in Section 3 of these Terms and Conditions.
2. General Terms of Sale
All vehicles are sold on an as-inspected basis. CARS GOLD takes reasonable steps to ensure that each vehicle is roadworthy and in the condition described at the time of sale. The following general terms apply to all transactions:
- A sale is considered final and complete upon full receipt of the agreed purchase price and the signing of the sale agreement by the customer.
- CARS GOLD reserves the right to refuse a sale or cancel a pending transaction prior to the completion of payment without obligation.
- Any representations, warranties, or promises made verbally by any staff member of CARS GOLD that are not recorded in writing and signed by an authorised representative of CARS GOLD shall not be binding.
- The customer is responsible for ensuring that all information provided during the sale process is accurate and complete. CARS GOLD bears no liability for errors arising from incorrect information submitted by the customer.
- Any additional accessories, modifications, or services agreed upon at point of sale must be documented in the sale agreement. Verbal agreements will not be honoured after the transaction is complete.
3. Two-Month Vehicle Guarantee
3.1 Guarantee Coverage
CARS GOLD provides a two (2) month guarantee on all vehicles sold, commencing on the Date of Purchase. This guarantee covers mechanical defects or failures that were present at the time of sale and that fall within the scope of agreed mechanical issues as determined by CARS GOLD or a qualified mechanic appointed by CARS GOLD.
3.2 What the Guarantee Covers
Subject to the exclusions listed in clause 3.3, the guarantee covers:
- Engine and drivetrain mechanical failures directly attributable to a pre-existing defect at the time of sale.
- Transmission faults that were not disclosed to the customer and that were not caused by the customer's use of the vehicle after purchase.
- Any other mechanical issue specifically agreed upon and recorded in writing at the time of sale.
3.3 What the Guarantee Does NOT Cover
The following are expressly excluded from the guarantee and will not be honoured under any circumstances:
- Normal wear and tear on any part of the vehicle, including but not limited to tyres, brake pads, clutch, filters, wiper blades, belts, and similar consumable components.
- Damage arising from misuse, negligence, reckless driving, or any form of accident or collision after the Date of Purchase.
- Mechanical failures caused by the customer's failure to maintain the vehicle in accordance with standard manufacturer or mechanical requirements.
- Electrical or cosmetic issues, including body panels, paintwork, upholstery, infotainment systems, and lighting, unless specifically agreed in writing at point of sale.
- Damage caused by flooding, fire, vandalism, or any other external event beyond the dealership's control.
- Modifications or alterations to the vehicle made by the customer or any third party after the Date of Purchase.
- Mechanical issues arising from the use of incorrect fuel, oils, or fluids after the Date of Purchase.
3.4 How to Make a Guarantee Claim
To make a valid guarantee claim, the customer must:
- Report the issue to CARS GOLD in writing within the 2-month guarantee period. Claims reported after the expiry of the guarantee period will not be accepted under any circumstances.
- Provide the original sale documentation or proof of purchase at the time of lodging the claim.
- Allow CARS GOLD or its appointed mechanic to inspect the vehicle before any repairs are undertaken by a third party. Repairs authorised or carried out by the customer or a third party without the prior written approval of CARS GOLD will void the guarantee entirely.
CARS GOLD reserves the right to assess each claim individually and to determine, at its reasonable discretion, whether the defect falls within the scope of the guarantee. The guarantee does not extend beyond the 2-month period under any circumstances, regardless of when a vehicle is used or driven.
4. No Return and No Refund Policy
4.1 Final Sale
All sales conducted by CARS GOLD are final. Once payment has been received in full and the sale agreement has been signed, the vehicle cannot be returned for a refund, exchange, or credit under any circumstances.
4.2 Change of Mind
CARS GOLD operates a strict no-return policy in all cases where a vehicle is in good working condition. If a customer purchases a vehicle and subsequently decides, for any reason whatsoever, that they no longer wish to keep the vehicle, CARS GOLD will not issue a refund, accept a return, or provide an exchange. This applies regardless of how recently the vehicle was purchased, provided the vehicle is functioning as described at the time of sale.
Reasons that will not be considered grounds for a return or refund include, without limitation:
- A change of personal preference or financial circumstances.
- The customer finding an alternative vehicle elsewhere.
- The customer no longer needing the vehicle.
- Dissatisfaction with the vehicle's features, colour, or specifications that were available for inspection prior to purchase.
- Any pressure from a third party to return or sell the vehicle.
4.3 No Cancellations After Sale Completion
Once the sale is complete, no cancellation of the agreement will be entertained. A sale is deemed complete at the point of full payment. Partial payment arrangements, where agreed upon in writing, do not constitute a completed sale until the full agreed amount has been paid.
4.4 Statutory Rights
Nothing in this clause is intended to unlawfully override any rights afforded to consumers under the Consumer Protection Act 68 of 2008. However, CARS GOLD notes that the Act's general right of return does not apply in circumstances where the vehicle has been sold in accordance with the customer's specific request, or where the customer had a reasonable opportunity to inspect the vehicle prior to purchase. CARS GOLD strongly encourages all customers to thoroughly inspect any vehicle before completing a purchase.
5. Business Transition Statement
CARS GOLD has taken over certain business operations and premises previously associated with the business formerly known as SG Cars. This transition is limited to operational continuity only and does not constitute a merger, acquisition, or legal succession.
The following applies without exception:
- CARS GOLD is not affiliated with, related to, or associated with SG Cars in any legal, financial, or operational capacity.
- CARS GOLD is an entirely separate and independent business entity operating under its own name and registration.
- Any pending disputes, complaints, claims, liabilities, debts, legal proceedings, or obligations of any nature that relate to SG Cars do not transfer to CARS GOLD and are not the responsibility of CARS GOLD.
- Customers or third parties with outstanding matters relating to SG Cars must direct all queries, claims, and legal actions to SG Cars directly. CARS GOLD accepts no responsibility for, and will not respond to, claims arising from transactions, agreements, or conduct that occurred under the name or operations of SG Cars.
CARS GOLD will not be held liable for any representations, warranties, agreements, or undertakings made by SG Cars, whether verbal or in writing, prior to CARS GOLD assuming its current operations. Any customer seeking redress for a matter involving SG Cars is advised to obtain independent legal advice.
6. Customer Acknowledgment and Inspection
6.1 Pre-Purchase Inspection
By completing a purchase at CARS GOLD, the customer confirms and acknowledges that:
- They have either personally inspected the vehicle prior to purchase, or were given a fair and reasonable opportunity to do so and declined.
- They are satisfied with the condition of the vehicle at the time of purchase, subject only to defects that may be covered under the 2-month guarantee as set out in Section 3.
- They have not relied solely on photographs, online listings, or verbal descriptions in making their purchasing decision, or if they have, they accept the risk associated with doing so.
- They have had the opportunity to request an independent mechanical inspection prior to purchase, and any decision not to do so was made of their own accord.
6.2 Acknowledgment of Terms
By completing payment and taking delivery of a vehicle from CARS GOLD, the customer confirms that:
- They have read and understood these Terms and Conditions in full.
- They accept all terms contained herein without reservation.
- They understand and accept the no return, no refund, and no exchange policy.
- They understand the scope and limitations of the 2-month guarantee.
- They acknowledge that CARS GOLD operates as a separate entity from SG Cars and that CARS GOLD bears no responsibility for any prior dealings under that name.
If the customer does not agree to any of these terms, they must refrain from completing the purchase. CARS GOLD staff are not authorised to waive or modify any of these terms verbally. Any amendments to these terms must be made in writing and signed by an authorised representative of CARS GOLD.
7. Limitation of Liability
To the fullest extent permitted by law, CARS GOLD shall not be liable for any indirect, consequential, or special damages arising from the purchase or use of a vehicle, including but not limited to loss of income, loss of business, or personal injury resulting from use of the vehicle after the Date of Purchase.
CARS GOLD's total liability in connection with any sale shall, in all circumstances, not exceed the purchase price paid by the customer for the vehicle in question.
8. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms shall be subject to the jurisdiction of the South African courts.
In the event of a dispute, the parties agree to first attempt to resolve the matter amicably through direct communication with CARS GOLD management. If a resolution cannot be reached within 14 (fourteen) business days, either party may refer the matter to the relevant consumer tribunal or court of competent jurisdiction.
9. Amendments to These Terms
CARS GOLD reserves the right to update or amend these Terms and Conditions at any time without prior notice. The version of the Terms and Conditions in effect at the time of a sale shall govern that transaction. Updated terms will be made available at the dealership premises and, where applicable, on the CARS GOLD website.
